Broker Associate License Requirements
Individuals who perform acts of real estate services in South Dakota must be licensed by the Real Estate Commission. For the purposes of the License Professor, a broker associate is similar to sales agents in other states. Purchasing the sales agent package and selecting South Dakota will provide you with national questions as well as South Dakota-specific broker associate questions.
Minimum Requirements to Apply for the Broker Associate License
- Basic: To receive a license, you must be 18 years of age or older, graduated high school, complete 45 hours of pre-license education, have an errors and omissions insurance policy. You will also need to pay all applicable fees, have your fingerprints electronically taken, and provide all required documentation.
- Education: Salesperson candidates must complete forty-five (45) hours of real estate education in real estate principles/fundamentals before they take the examination, from an accredited real estate school in South Dakota.
- Residence: License applicants must provide Proof of Legal Presence in U.S. If not a South Dakota resident, you can still apply for a reciprocal license or as a nonresident candidate. The SD Real Estate Commission has reciprocity agreements with Georgia, Iowa, and Minnesota, and if you hold an active broker associate or broker license in one of these three states the licensing examination is waived. You will still need to pay applicable application fees and have errors and omissions insurance. Nonresident candidates still need to pass the state portion of the South Dakota broker associate examination.
- Honesty & Integrity: License applicants must be honest, truthful, financially safe, and deal in good faith. Conviction of a crime may result in the denial of a license. The failure to reveal a criminal conviction on an original license application may also result in the denial of a license. For further information regarding the license issuance process when an applicant has a prior criminal conviction, please visit the South Dakota Real Estate Commission.

A South Dakota Real Estate Broker License is required of individuals who want to employ broker associates under their supervision. A license may be obtained by broker candidates that have an active South Dakota license that they have used full time for the previous three years. - Education: Before applying for a broker's license, you must complete the Commission-approved 60-hour broker pre-licensing education course. These are different than continuing education courses. Alternative courses of study that are very similar to the specific pre-licensing courses may be able to satisfy the education requirement.

What score do I need to pass the South Dakota Broker Associate Exam?
The broker associate exam contains 100 national questions and 57 state-specific questions (5 are pre-test questions and do not count towards your score). Each question is judged by experts for what would be a score for a “minimally competent practitioner†(MCP) based on their difficulty. The minimum passing score is then computed by averaging these judgments.
What score do I need to pass the South Dakota Broker Exam?
The broker exam contains 12 national simulation problems. A minimum passing level (MPL) is assigned by experts, who judge the simulations to create the overall minimum passing level.
Can I get a South Dakota real estate license if I have a criminal record?
Just because you have a criminal record, it does not mean that you will be prevented from receiving your license. It is always best to provide details on your application. If you are unsure, you can always call the commission to clarify what type of convictions are allowed, and which are not.
